Legal Aid For Motoring Offences

Overview

We are able to provide representation under legal aid funding in certain cases. Whether you qualify depends on two tests set by the Legal Aid Agency.

Interests of Justice Test

This test considers the seriousness of the case and whether it is in the public interest for you to have legal representation.
You are more likely to qualify if:

  • You face a risk of imprisonment
  • The case is complex
  • You have previous convictions
  • You are vulnerable
  • The case involves legal or evidential issues

Means Test

Your financial circumstances are assessed to determine whether you qualify for legal aid in full, with a contribution, or not at all.
This assessment considers:

  • Income
  • Outgoings
  • Savings
  • Any partner’s income (in some cases)

If you do not qualify, we can discuss fixed fees or private funding options.
