Parent Focused FAQs

Supporting families when a child or young person is involved in the criminal justice system
My child has been arrested — what should I do first?
Stay calm and ask the police to contact us immediately. Your child should not answer any questions until they have spoken to a solicitor. You have the right to be informed and to attend the police station.
Normally you would be asked to attend. Anyone under 18 must have an Appropriate Adult present — usually a parent, carer or trained adult. We make sure the interview is fair and your child is not pressured.
They can be, but only when necessary. We challenge unnecessary detention and ensure your child’s welfare needs are met, including food, rest and medical care.
If your child has to attend court, we can arrange assessments and request an intermediary to help your child understand what is happening and to communicate effectively.
This is extremely common. We are experienced in raising exploitation and section 45 Modern Slavery Act defences. If your child was groomed, coerced or scared, the court must take this into account.

Not always. Many cases end with no further action, diversion, or cautions that do not create a long term record. Even where there is a conviction, youth records are treated differently and may be spent or filtered more quickly than compared with an adult.

The Youth Court is more informal than the adult court and specifically designed with a ‘Child First’ approach. Your child sometimes will sit with you. The language is simpler, and the focus is on understanding the child’s needs and supporting them to move forward.
Yes, in certain situations — for example, if there are adult co defendants or the case is too serious for the Youth Court. Even then, the court must still apply youth sentencing principles.
Not necessarily. Youth records are treated differently, and many outcomes do not create long term barriers. We work to protect your child’s education, opportunities and wellbeing.
